Ted Stevens’ lawyers have asked Judge Emmett Sullivan to overturn the jury’s verdict. That’s right, just toss the verdict out and rule for an acquittal.
And if he won’t do that, then they’ll settle for a new trial. In Alaska.
And if he won’t do that, then they’ll settle for a new trial.
AND they want 6 of the 7 felony counts dismissed because they are the same as the first felony count.
They also asked the judge to allow them to file some exhibits in support of their motions under seal because the exhibits refer to personal information about jurors and to the ongoing investigation by the government into political corruption in Alaska.
This might have something to do with Juror #9 who had “violent outbursts” during the deliberations, and whom all the other jurors wanted off the island. Or, it could have to do with Juror #4 who lied about her own father’s death, and skipped town to watch a horse race. Or, it could have to do with our favorite Juror #11 who has been talking to the press and keeping a blog that describes some interesting goings-on behind the scenes. And now, it appears that the defense has been doing some investigative work that reveals what they believe to be jurors who lied on their forms and failed to disclose relationships with the criminal justice system that could have made them prejudicial against Stevens, and politicians in general.
AND they say that Bill Allen, former CEO of Veco Corp, and key witness for the prosecution lied when he said that the friend of Stevens who was overseeing the renovation said, “Don’t worry about getting a bill. Ted’s just covering his ass.”
Under an earlier schedule set by U.S. District Judge Emmet Sullivan, the government has until Jan. 9 to respond to the defense’s post-trial motions. A hearing is set for Feb. 25.
In asking for a new trial, the defense lawyers said Stevens’ trial was fatally flawed with false evidence presented by the government, improper hearsay evidence from a witness who was the “linchpin” of the government’s case, and by jurors who lied to the court and were prejudiced from the start against politicians.
Such post-trial motions are common in criminal trials but rarely succeed before the trial judge, who has ruled upon most if not all of the arguments before. However, they set out the basis for a likely appeal, and could also be used by advocates seeking a presidential pardon for Stevens to assert he was tried unfairly.
Like it or not, the Stevens trial continues. Trialophiles will want to read the entire article in todays Anchorage Daily News.

Wish we could find more judges like the one in the OJ trial – she said he was arrogant and ignorant. Hahahaha, I loved seeing him squirm and whine – it’s that type of arrogance that gives people the impression that they are above the law; he got his and I hope the High Plains Grifter gets hers.
What really irks me is the fact that both Stevens and Palin never accept responsibility for their actions. They continually do what they want and think they are exempt from the law. If I lived in Alaska I would be seething.
And it doesn’t help that they had some looney jurors!

This summer, Alaska wildlife agency personnel reportedly staked out a known wolf denning site – a practice that is illegal under Alaska law – and, using helicopters, gunned down 14 adult wolves from the air.
When they landed, they found 14 helpless pups in the nearby dens – infant wolves just weeks old – and methodically shot each one in the head. 28 wolves gunned down in all.
Here’s a prime example of her administration’s belief that they don’t have to follow the law; obviously the governor thinks she doesn’t and that has trickled down to her state agencies. Honestly, anyone should be ashamed to be a part of this.

In their defence, Stevens’ lawyers are doing exactly what good criminal lawyers do: Find every possible irregularity and exploit it. Another way to describe it would be they throw all the sh^t at the wall and see what sticks.

It’s snowing in Chicago too. AKM, again, thank you for keeping us informed. Our former governor, George Ryan is currently in jail for corruption in issuing driving licenses. He was prosecuted and found guilty in part because at the end of his term, he placed a moratorium on executions for the inmates on death row. That decision did not sit well with rabidly pro-life, pro-death penalty upright citizens of influence. Most death row inmates were nonwhite. In Chicago, we have suffered the infamous reign of Jon Burge (torturing arrestees, forced confessions, lies, cover-ups, ad nauseum).
University law school students, working with seasoned professionals, uncovered many falsely imprisoned men who had served long years were proven innocent with police brutality, sloppy police, and substandard legal defence work at the root of the convictions. Chicago is still paying the pension of Jon Burge, retired in Florida. The City paid millions of dollars to defend the rogue cop including settling civil law suits. The police union has taken up the defense of the perjury charges against the ex-cop. Former Gov. Ryan had his pension denied.
Politicians here have requested that Bush commute George Ryans’ sentence without a pardon which may not happen since George Bush happily approved executing even the mentally incapacitated as governor of Texas.
All this to say–Alaskans should not be surprised if Ted Stevens gets his way and has his convictions ‘tossed’ out. Lord, help us all.

Hope snow sticks in Park City, where they call it the Greatest Snow on Earth because of the powdery fluff, and the 2002 Olympics were held there, plus the Olympic ski team is based there. I MAY be going next week to one of my condos (overlooks the Ski Jump/BobSled venue) there to meet a colleague from NYC and his family. My snow clothes get no use in So Cal (wearing sandals today).

Ok…so Senator Stevens. I don’t know what to make of this. I think that the request to reverse the first verdict is completely bogus and stands no chance of passing in court. The best that he can hope for is a retrial. I also tend to think that the change of venue request is a definite stretch. Obviously his lawyer feels that he will stand a chance at getting a more lenient jury in his home state, but I feel that since the first trial was held in DC, then the retrial should also have to be held there. I think any retrial should include all the same charges that were brought in the first trial. It seems like his lawyer would have made these claims of the charges being redundant before the initial trial. I’m no lawyer, but that just seems to make sense to me.
Back to the snow…I like how it collects at the bottom of the window. 🙂

I even think we should legalize most illegal drugs, but mostly because its just about as effective as Prohibition was. I’m one of a few who doesn’t believe the church is infalliable, if you reach out to him, maybe he can be one too (and if he needs help getting there, ask him about blacks and priesthood, there’s no rationalizing that one).
And AKM, the snow is beautiful. It’s even sticking to the sides of the column (look over to the line between the white and grey).

In fact, some people might have wondered why John McCain, if he was so desperate for a woman on his ticket, ignored a well-traveled, independent-minded experienced legislator who does her homework in favor of an out-to-lunch moose-murderer who cannot seem to put together a coherent sentence.
“Well, you know, John made the decision he did,” said Snowe vaguely.
Snowe seems very conscious of how key her role could be over the next few years, since she talks about building bridges with the enthusiasm of an Alaskan pork-monger. I agree about today’s GOP socio-religious conservatives. They are descended from McCarthy, via Reagan. The original conservative Republicans began with Goldwater, a conservative who espoused fiscal restraint, but was a social moderate. Limited government, but services for those who need a hand up.

I just watched a replay of Barack on Letterman’s show on 9/10. I LOVE THAT MAN, BARACK!!!>/b>I was laughing so hard when he explained the “lipstick on a pig thing” it was so funny, he has so much warmth and personality. I was too young to feel anything but extreme sadness JFK and RFK.
