Branchflower Public Report Released!

The Legislative Council has voted unanimously to release the public portion of the report!

Findings:

Finding Number One:

For the reasons explained in section IV of this report, I find that Governor Sarah Palin abused her power by violating Alaska Statute 39.52.110(a) of the Alaska Executive Branch Ethics Act. Alaska Statute 39.52.110(a) provides

“The legislature reaffirms that each public officer holds office as a public trust, and any effort to benefit a personal or financial interest through official action is a violation of that trust.”

Finding Number Two:

I find that, although Walt Monegan’s refusal to fire Trooper Michael Wooten was not the sole reason he was fired by Governor Sarah Palin, it was likely a contributing factor to his termination as Commissioner of Public Safety. In spite of that, Governor Palin’s firing of Commissioner Monegan was a proper and lawful exercise of her constitutional and statutory authority to hire and fire executive branch department heads.

Finding Number Three:

Harbor Adjustment Service of Anchorage, and its owner Ms. Murleen Wilkes, handled Trooper Michael Wooten’s workers’ compensation claim properly and in the normal course of business like any other claim processed by Harbor Adjustment Service and Ms. Wilkes. Further, Trooper Wooten received all the workers’ compensation benefits to which he was entitled.

Finding Number Four:

The Attorney General’s office has failed to substantially comply with my August 6, 2008 written request to Governor Sarah Palin for information about the case in the form of emails.

Sadly, the recommendations for action are all quite mild and minimal. Basically, that section acknowledges that it’s hard on people not to know whether their reports and concerns have been acted on, but given the confidentiality of personnel matters, it’s not possible to give complainants information about how the complaints were handled. So folks like the Palins and Heaths should be assured that action is being taken. Big whoop.

It will be all too easy for the spin to focus on the “concerned” family members and their “understandable” desire to know whether action had been taken. I LOVE that the first finding was Abuse of Power, but I fear that many of us had higher hopes than seem to be justified.

I expect that the Mad Dog will remain on the ticket, along with her lipstick and the corpse of her soul-less running mate. And the platform that she’ll do what’s Necessary (maverick maverick), even if it’s seen by some as an abuse of power, will make her even more popular with the little hate-filled “base” that attends her rallies and reveres her name.

The recommendations do not appear to recommend discpilinary action against the governor, solely changes in the laws to clarify who has access to what. Granted I skimmed it very quickly.

Thanks to all Alaskans for pursuing justice.

Now let’s see if that will translate to the polling place.

The thing is, Monegan was an “at will” employee as are most employees in the US (commonly called the at-will doctrine). This means, absent an employment contract or something else that promises an employee may only be fired for certain stated reasons (e.g., an employee manual that contains such info), an employer may terminate employment for any reason or no reason and, likewise, an employee may leave his/her employment for any reason or no reason. Note there are other exceptions to the at-will doctrine (e.g., whistle blowers), but it’s Friday and I don’t think anyone here wants to be bored with legal stuff! :o)

P.S. I recall reading somewhere that Monegan did file a lawsuit regarding his alleged wrongful discharge, but he lost. This investigation was not intended to provide a finding on whether Monegan’s firing was legal. Anyone, everyone: please do correct me if this is incorrect.

I agree with Coyote Marti that “abusing the public trust” is going to be the real sock in the gut to the McPalin ticket. She will stay on the ticket. It’s just too late to take her off unless she is shipped back to Alaska for arrest, which is unlikely.

Might I be magnanimous and suggest that all of us who emailed the Legislative Council members encouraging them to release the report, send them a follow-up email thanking them for their service and for doing the right thing? Of course the Dems had a clear path, but I’m sure the Republican members were harrangued by their Party as well as by the public. To be fair, that had to have been a tough decision for some of them. And I do appreciate that it was unanimous…

Oh, and WHOO-HOO!! Abused power and broke the public trust. It is sweet when the investigations come out with the truth!

My question is basically, how can someone be in violation of a state statute, but not have broken a law. Yes the Executive branch act is not part of the criminal code, but I’m fairly certain that doesn’t make it any less of a law. But I’m not a lawyer…. so I could be wrong on that.

yeah, anyone who thinks this is a wash should wake up and smell the coffee.

sure, legally, she can fire anyone for any reason. except if it is for personal or financial gain.

basically, the hedge in the finding is giving her a big benefit of the doubt that any of the hundred excuses she and todd have run up the flag pole might possibly be true.

but the issue never was the legality of monegan’s firing, it’s always been whether she was guilty of abuse of power. and the finding is exactly that — sarah palin did indeed abuse her power as governor to pursue a personal vendetta.

congratulations to the brave and honest folks in the alaska legislature for the investigation and timely report.

what’s next?

i can’t imagine there would be any serious attempt to impeach or recall her at this point.

Couple of things,

I read the first part of the report on adn. Branchflower included NO information from the sleazy seven who didn’t respond on time to their subpeonas, all of whom were in her adminstration and would be forced to tell the truth under oath, so there could be much more coming. Also, the emails are not included in this, so there is another possible goldmine of info.

Does anyone know who the members of the Personnel Board are and who appointed them?

I’m hearing conflicting information about whether or not she has been found guilty of an actual crime. Do any of you Alaska folk know if the “violation of the public trust” constitutes the violation of a law? (BTW, that is a GREAT law you guys have up there if it is one).

As I am a Jew, it’s been a very distasteful week of such vile
ugliness. A woman who claims to be a moral Christian has proven she’s
nothing more than a thug in high heels.

Since you’ve been busy, you’ve undoubtedly missed the bulk of other
political news today. A woman at a McCain rally said she didn’t like
obama and couldn’t trust him, because he’s an Arab.. McCain had to
backpeddle like a madman, saying he’s a nice man and a citizen, etc
etc.. McCain’s own crap may be his death knoll.

Even my ex-wife drank the GOP koolaid. Fortunately, my kids are
smarter than their mom and are both voting Dem.

I live outside of DC, so I hear all the stuff and this election have
been so much more in tune than usual. There is so much on the line
than usual. And we all see how well W has done..!

According to an interview on MSNBC with a reporter covering this story, the ethics violation is a criminal offense. It is up to the committee to either recommend censure or impeachment. Given the republican majority in the legislature, I’m not sure how far they will go with either of those. Now would the criminal investigation be brought by the state attorney general?

Palin didn’t break any state or criminal law.. As Govenor, she is allowed to fire Monegan. There was no question of that aspect of this case. I don’t think anyone expected her to be found guilty of that part of the investigation.

What she DID was fired him after harassment and non-stop pressure to fire Wooten for personal reasons. That is where the Abuse of Power and Abuse of the Public Trust aspects come into this mess..

That is what she did, what I was personally hoping for, and thats exactly what she got.. This is very devastating and she will be in serious doo-doo when this is over and done with.

I wouldn’t be shocked if she leaves the ticket over the weekend.. Her power of her voice is muted and her charisma has been damaged probably beyond repair..

Basically, Palin is fu-ked.. Hope this helps.

Read pp 83-84 of the report — Wooten had submitted an application to the Wasilla police department, but it was not even being considered by the department because “as long as there had been discipline going on and thre was potential, until that would have been resolved, we would not consider him as an applicant for the Wasilla Police Department”.

Irony…

The Wasilla Police Dept has higher standards for consideration for a position with them than McCain had when choosing a VP candidate.

Legal team chiming in here. The first two findings at first glance do seem contradictory — she abused her power, but the firing was lawful.

It might help if we flip the findings.

First … firing Monaghan was lawful. Even tho Palin’s decision to fire him was motivated at least in part by his “failure” to get rid of Wooton, she was within her rights to fire him. For any reason, or no reason. That’s what “at-will” employment means. So, firing Monaghan was not a violation of public trust or abuse of power (even tho sleazy).

Second … Palin DID abuse her power by taking official action (hundreds of phone calls, emails, and conversations with government officials to muscle them into taking action against Wooton) to benefit a personal interest (influencing her sister’s divorce/custody action, or personal retribution against Wooton). Official action to benefit a private interest is the abuse of power. But the official action in question was not the Monaghan’s dismissal, rather it was her (and thru Todd) sleazy attempts to use the machinery of state government to settle a personal score.

The more I think about it, Palin must have been extraordinarily frustrated that she could not fire Wooton directly. As a police officer, he was (and is) not an at-will employee, but a contract employee represented by a union, and a detailed process must be followed to discipline or fire him. And, that procedure WAS followed, as Wooton was reprimanded and suspended on account of the moose-shooting and alcohol violations. Palin is used to having her way (look how she fired all the top managers in Wasilla to replace them with her school chums), and it must have killed her that she was pretty much powerless against Wooton.

OK, my last 2 cents. The finding that Harbor Adjustment fairly handed Wooten’s workers comp claim begs the question … did the Palins improperly try to influence that also? Maybe the full report will tell us more.

That’s where all the dirt is residing. The guy in wasilla who owns the network admitted to making a complete copy before palin deleted her personal copies.

So, she may fry yet again once her secret emails are revealed and God only knows what crap she’s hiding in there she really, REALLY doesn’t want revealed..!!

The email may be more damaging than the Troopergate stuff, especially if she conducted Gov business illegally off the AK email network. That could actually end up being a felony and prison time.

INTRIGUED ~ Lumping incidentals like vet care & vehicle maintenance in the same category as medical care is ridiculous. Health care may not be a right BUT it is the LEAST our country can do for those who can’t get it.

Do you know what it’s like to be poor? To have a quarter in your pocket and not know whether to save it for a phone call or a packet of Kool Aid because all you have is water to drink? RETHUGICAN SPIN:
She had the right to fire Moneghan.

REBUTTAL:
She did have to power to FIRE Monegan, not but the power to fire Wooten. The probe was never about the firing of Moneghan, it was about the attempt by Flailin’ to FORCE Monegan to fire Wooten, using her position as governor as leverage. The probe was about the “termination” of Monegan and “potential abuses of power and/or improper actions by member of the executive branch.” See page 2 for the contract’s terms.

VERDICT:
Flailin’ did NOT have the right to force the firing of Wooten, therefore, her forceful and repeated attempts to have Monegan fire Wooten were a direct and absolute violation of the state’s ethics law.

Logic…beyond Rethugicans in-tel-ligence…

I like the fact that someone on Rachel’s show, I think the columnist from the Anchorage paper pointed out that Palin said she was afraid for her family’s welfare from Wooten right after dismissing her personal security detail. Governor you cannot have it both ways.

I’m ignorant of Alaska law and politics, and just checked in here to better understand what happened with the report that just came out. Does the Legislative Council’s unanimous decision to _release_ the report imply unanimous _approval_ of its findings? Is it safe to assume that if any of the Republican members found it to be partisan, they would have voted against releasing it?

Just called my parents– Mom’s a lifelong Democrat and my dad a lifelong Republican. Both college educated, etc. and retired snowbirds currently in WI. My dad flipped and voted Obama by absentee ballot already! This is huge news and I couldn’t be more proud of my dad right now. I have always thought he is one the smartest people I have ever known and this proves it. I had to tell them about the Troopergate report since I have been bombarding them with information. They have been amazed I have been so vocal in this election. As a voter since 1986, the is the first time I have ever really gotten this into it, but this election is way too important to just vote quietly, spread the word. I have and it paid off!

So I managed to pack a whole day’s work, a wedding AND a wedding reception into to the time they took to decide to release the report! Seriously, though, I think I’m glad they took the time to consider and discuss all of it. It will be much more difficult for the McCain campaign to spin this as a partisan decision if they really took that much time. And the fact that the vote was unanimous is just the icing on the non-partisan cake!

That stuff should quite rightly be kept out of the private eye. Would you want just anyone to know details like your birthday, social security number and income?

It is actually good for all to have a RIGHT for healthcare!

I posted on this before, and feel very strongly about it. Amazingly, many of us do not realize that it is a common interest to care for healthcare for all.

Imagine tomorrow you fall under a truck. The driver who hit you disappears. You are severely injured and it takes a year to recover. Your insurance pays for a while, then you loose your job after 6 months (your employer was still very kind, you see). Then you go for a new insurance, but you have a preexisting condition. Would you like to be in such situation???

The US spends twice as much on health per capita compared to the richest Europian countries where health coverage is general. This is while 40 million people are without insurance in this country… (Spending combines insurance and direct costs).

The reason? Insurance companies spend the money ON DENYING YOUR CLAIMS. From the ecomonic point alone, it is better to have a basic coverage for everyone. If you wanted you could add to it additional insurance for hair transplants etc.

In summary, why is it good to have general healthcare?
a) it is more ECONOMICAL ( will cost you less even if you care for your fellow citizens – strange isn’t it?)
b) it is more humane with dignity for all
c) it makes the nation healthier and a stronger workforce

Most of us, most of the time throughout our life are OK and healthy. So those with bad luck (sudden illness, preexisting conditions…) are in the minority. Are we realy so selfish that we cannot recognize it is in OUR OWN interest (reasons a,b,c above) to provide healt coverage for all.

You will only wake up when you are diagnosed with a life threatening condition, loose your job, your house. Then one day you cannot afford insurance any more. And the insurance company decides you had it all the time as a preexisting condition. But then who cares? You are just the misfortuned minority…. Please think.

I lived in Europe, where no one asked me about insurance if I went to the doctor. I had additional private insurance just to be on the safe side – I could afford it. The full cost of that was still LESS than what I pay today as the 10% contribution to the insurance covered by my employer. I bet if you walked into a surgery in the EU you would get instant treatment as a US citizen. And no local would object that he/she should not pay for YOUR treatment…

Would you suggest we go back to the stone age, survival of the fittest and f*** the rest? Let’s also disband the police. Instead, we could each carry arms and have PRIVATE security. Is security a right? Let’s disband firemen. You could have a contract for fire occurences. Why should I pay for firemen? I never had fire. Never had robbery either, don’t need police. Just realized, why should I pay taxes?

You can have right for all the happiness you want…
As long as you make sure you are happy to be sick.

If I remember correctly, a few days ago it was reported that several members of the committee would only report on the limits of the of the original investigative requirement. That was specifically associated with the firing and the behaviors associated with it. It is probably the case that the investigation turned up much, much more and now they have to decide how to deal with that information. That is now a separate issue. So what does the legislature do?

McCain-Palin campaign spokeswoman Meg Stapleton said Palin would cooperate with the Personnel Board investigation. The Palins’ lawyer has said an investigator named by that board wants to question them in late October.

Stapleton called the investigation “a partisan-led inquiry” run by supporters of Democratic presidential candidate Sen. Barack Obama, but hailed its finding that Monegan’s firing broke no law.

“Gov. Palin was cleared of the allegation of an improper firing, which is what this investigation was approved to look into,” she said.

Stapleton went on to say that the Legislature exceeded its mandate in finding an ethics violation. “Lacking evidence to support the original Monegan allegation, the Legislative Council seriously overreached, making a tortured argument to find fault without basis in law or fact.”

If you are in the lower 48, all you have to do is look to the border north as Canada is the same with healthcare as Europe.

I hear the politic talk that it will cost so much and to just figure it out & put it all together. Well, if they used a brain cell, they have Canada, the UK, Europe, none of which are third world countries. At times I’ve wondered by the comments they have made as to our drugs being unregulated and unsafe. The one time that really sticks in my mind is as we get free flu shots across the country, there was a shortage of vaccine in the US. We had extra supply and offered to US. It was turned down as there would be insufficient time to do the testing on it. They acted like our government would have given us poisin. Thanks Bush for the slap in the face. Even Hasselbeck on the view parroted the same words of course. Man if I could have B-slapped her!! In the meantime, you had a number of deaths because of their stupidity as no vaccine was available to you. A number of young children & seniors died.

As to changing the system, they can meet and go through and learn so much information on healthcare programs that has been in place for years and learn from that from all of the various countries. They are not inventing the wheel to go this route.

Hope they finish their meetings by Tuesday as he may not be the Finance Minister anymore — our Federal Election is Tuesday. Word on the street though is his party will probably win another minority. As for the banking — I only this week inquired as to bank insurance etc. Your news kept pounding at it and Washington’s constant Fear Factor statements — finally got to me about Wednesday. I learned that the CDN banks were no where near as deep into the subprime like everywhere else in the world. One of my banks didn’t touch it.

Cassie-it is my understanding that McCain has realized that the only base he has left are the Klanners with pitchforks, and has made two clear attempts today to simmer things down. He told one group that Obama was not someone to be feared-that he is a nice, respectable family man, and they should be respectful. In another speech, he told an audience member that Obama was NOT Arab or Muslim. I think that McCain has realized that he is going to lose and he doesn’t want to be connected in any way with an assassination. I am pleased that he has made this decision, and maybe he can find some leadership now that his base needs it.
I hope that his decision to simmer down the rhetoric he started works, and Barack, Michelle, Malia and Sasha have long, happy lives. Because yes, it scared me.

Also, this investigation was going on before his tantrum about Lieberman when he chose her to piss off the status quo. They did everything to cover this up, and stop the investigation so now come to think of it..sure sounds Political to me..Republicans once again corrupt and tried to bully their way into a cover up. I think the fact that they found she didn’t break the law, she has a 10 republicans to thank. She released a statement of her innocence before the report was released so SOMEBODY called her. But they obviously didn’t tell her she wasn’t found innocent either.

I posted a lengthy post on one of the last couple of threads, not sure which one re healthcare with some pros & cons.

A couple of points that jump out for me all the time — 1) We don’t loose our houses or have to declaire bankruptcy due to medical bills. 2) Seniors over 65 – almost all prescriptions are paid for. No need to make a decision — do I buy food or do I buy my prescription. 3) Ontario Liberals bring back health care premiums in 2004. Payroll premiums (haven’t changed since 2004) will cost individuals $0 with income under $20,000 to $900 a year with incomes over $200,000. Therefore I can’t understand their BS. So if it was $1,500 a year — big deal. Then everyone is covered i.e. population. We wait a bit for some things but get past the instant gratification thing and wow — everyone is covered. People can learn more by searching Ontario Health Care Premiums 2008 & it gives links to other info re what it covers. Worth booing at as so many turn their nose up at it. A major difference of $$$ to US premiums. $5,000 a year credit — I could buy Blue Cross etc. & get private room, etc. and still not use the $5,000. Not cover – eye test age 20 – 65. Chiropractic. Physiotherapy except seniors in nursing homes or homecare. May be a few other things I can’t find but big difference if you know you don’t worry about your house or bankruptcy.

Actually, the bulk of drug companies — same as yours. Offices here & there. No diff except for labels on the bottles & packaging!!! They do research here too.

Fox and the like are focusing on “the firing was just peachy!” and glossing over Finding #1. Rachel Maddow was pretty specific when she said “she violated the trust” very clearly and specifically several times.

She also talked to Walt M. by telephone. He was bummed that the firing was deemed OK, but felt somewhat vindicated on Finding #1. Not thrilled…

McCain had to take the mike from TWO people at a rally today to defend Barak Obama! One woman said “I don’t trust him, he’s an Arab.” When making his statements defending Obama, he received boos and cat-calls from the audience.

Not a good day for the Republican ticket.

3) We are talking about members of the Republican Party – Bush and Cheney et al have gotten away with the worst kind of Abuse of Power for 8 years – lying to the public, twisting facts to make a case, going over and above their Constitutional rights, not releasing info, etc, all worse than this and NO ONE HAS MADE THEM TAKE ANY RESPONSIBILITY for any of it. Agree with Glenn re : Health Care – I live in France which supposedly has the best health care system in the world. In addition to your positive points :

I add D) (which may be an extension of C) : because when the country is paying (with our social charges), they realize that a healthier population is cheaper than if everyone just waits until they are sick to get care, so the French system is based on preventive medecine : kids up to 18 get yearly free dental check-ups, yearly pap smears and mammographs are free for women as are monthly, then weekly check-ups during pregnancy including monthly blood work and 3 sonograms, amnioscentesis for over-40 pregnant women, vaccines are reimbursed, and the list goes on and on. This sytem also keeps check on the cost of visits and the cost of medecine. The system is constantly updated to try and keep abuse to the minimum.

For almost 2 years my husband was unemployed. We still got the state health coverage, but we didn’t have any more employee complementary coverage (which ALL employers must offer). We went to a local insurance office – the insurance offered by our region – had a choice of about 4 levels of coverage (you choose depending on what you think you will need) and we got complementary coverage for our family of 4 – including complete orthodontia coverage for our kids – all for 104€/month. Breath a sigh of relief.

I know lots of state employees and they are actually AFRAID to go to this rally without a disguise!!! What, are they expecting Tiannamen Square or something?!? Geena, I am for a more informed electorate. The ads that are being put forward by the GOP, the McCain campaign and others are not informed nor are they true. Unfortunately, there are people who do not inform themselves of the truth, but believe what is spoon fed to them.

The GOP was once for less regulation by government. We are now reaping that eight years of non regulation. McCain has voted with Bush 90% of the time, which would lead me to believe that he is going to continue with that deregulation. Except his new policy of buying the morgages (with tax payer money) of those in need of help. Nice idea. But this means as tax payers we will be buying those morgages high and selling them cheap. Is not this buy out a more intrusive government?

I’m tired of being lied to by those in the WH and those who support them. Perhaps we might claim some of our constitution back? Perhaps we don’t need the government saving pillow talk between husbands and wives overseas?

If you’re interested, I’ve gone through a large hunk of the Branchflower Report and Todd Palin’s interrogatory statement and written summaries. I believe that the Branchflower Report is pretty damning. What happens with it, however, will remain to be seen. If nothing else, I think Mike Wooten could get a large employment harassment settlement against the State of Alaska and probably some of the individuals working there (like Todd, Sarah, and Frank Bailey). The pages of interviews show that the Palins have run roughshod over process, do not understand reason and cannot comprehend the words “no” or “stop”, gained access to confidential personnel information they really shouldn’t have in their possession, and take any perceived slight extremely personally. And Todd Palin is functioning as an authoritative force in the governor’s office and calls way too many shots. Oh, and the Palins lie. And the more they try to deny it the stranger they sound. Mike Wooten’s no angel, but the Palin’s are just plain nasty.

1) The “Troopergate” report is one (clearly biased) investigator’s opinion – the members of the investigative commission merely voted to release the report, without expressing agreement or approval at this point – in fact, it appears (from preliminary statements) that there is substantial controversy over the validity of the report as released. At least one member of the Alaska Legislature has publicly expressed serious doubt concerning the veracity of the report as released – it seems likely that there will be more to come.

2) The first two “findings” in the released report are directly contradictory, and it appears that the investigator has stretched his own interpretation of the statute cited in the first “finding” extensively beyond anything logical or even reasonable, purely in order to try to produce a conclusion that is unfavorable to Governor Palin. The second “finding” – that the Governor acted properly and well within her authority in reassigning (NOT “firing”, as the investigator alludes) Monegan – is clearly the substantially more important matter, and (despite the investigator’s expressed OPINION concerning motive, which is NOT supported by fact, and which is contradicted by Monegan’s own prior statement) is also clearly in the Governor’s favor.

3) This report, as bloated and wordy as it is (all 263 pages’ worth), is NOT the whole report – there is much more which has not yet been seen – nor has it been reviewed, debated, agreed with, nor in any way, shape or form been accepted by any part of the Alaska Legislature; nor, in fact, has it even been approved of by the Legislative Council who voted to release it. It is entirely the work of one partisan and clearly-biased individual, motivated and paid for by one Alaskan Senator who is also clearly an advocate for Barack Obama, and an enemy of Sarah Palin. It cannot, therefore, be considered to be anything more than an attempt to besmirch Governor Palin as a purely political ploy by one or more advocates for Obama/Biden. The only useful part is the second half of the second “finding” – the rest is slanted, partisan dreck.

Sorry to burst your little bubble – but them’s the facts.
