Sorry to interrupt the Republican “Non-Implosion is Victory” party, but there was some breaking news in Anchorage tonight that came out a couple minutes before the debate.
An Anchorage judge today refused to halt the Legislature’s investigation of Gov. Sarah Palin and denied the state attorney general’s attempt to throw out legislative subpoenas.
Superior Court Judge Peter Michalski heard arguments from both sides this morning and ruled just before 5 p.m. this afternoon.
“I think it’s great. It’s a big day for the state of Alaska,” said Peter Maassen, the lawyer representing the Legislative Council, which ordered the investigation.
Maassen said he expected the other side to attempt a last-minute appeal to the state Supreme Court.
It’s last-minute because the investigator hired by the Legislative Council, Steve Branchflower, is to present his report in a week. Branchflower is looking into Palin’s dismissal of her public safety commissioner, Walt Monegan, and whether she improperly pressured him to fire a state trooper divorced from her sister. There is intense national interest in the outcome now that Palin is the Republican nominee for vice president.
Alaska Attorney General Talis Colberg said he didn’t know whether he’d appeal or if he’ll now advise the subpoenaed state officals to cooperate with the investigation. He said he needed to consult with them.
“I’m going to talk to the clients before I talk to you,” he said.
Five Republican state legislators sued to stop the investigation, and Colberg, a Palin appointee, asked the judge to throw out the legislative subpoenas. The governor’s husband, Todd, and nearly a dozen state officials have refused to honor the subpoeanas ordering them to testify, and they face the threat of possible jail time.
Thomas Van Flein, the Anchorage attorney representing both Todd and Sarah Palin, watched the court hearing today. He said in an interview afterward that, if the judge refused to throw out the subpoenas, he would expect Todd Palin to testify after all.
“Short of appeal to the Alaska Supreme Court, which no one has talked about, I don’t see why we wouldn’t just have Todd testify,” he said.

I really tried to watch this debate as an “unbiased” viewer (even though I am DEFEINTELY biased towards obama) In the first 45 minutes of the debate, I do have to admit biden was weak on talking to to the average american…( he tended to look aat gwen which on camera showed him NOT looking at US, the people) last part of the debate he corrected that. if I were NOT a huge biden/obama…obama/biden fan…I would say sarah kinda/sorta held her own with the help of all those notes she had…and obviously had memorized…which is WAAYY better tan her speaking “off the cuff”

The Biden victory will become much clearer tomorrow and over the weekend, when people have time to watch it again and write about what really happened, count how many times she went to the stump speeches instead of the answers.

Alaska judges are picked on merit, and while Republican governors can usually be counted on to pick the richest white male in the bunch, they are pretty independent.

I think Biden won this debate, no doubt about it. I just couldn’t take all that winking, blinking, and those cutsy sayings she has…she is like Gidget on steroids. She gave Tina Fey plenty of material for her next SNL skit.
My favorite moment of the debate was when Joe Biden laid into John McCain about being a Maverick. My least favorite was when Palin showed absolutely no empathy for him when he was talking about his children. She was so afraid of getting off her talking points.
There are a lot of other things to be said, but I want to congratulate the people of Alaska/America on their/our victory today. Can’t wait for the next Squad of Truth briefing. Truth Squad sounds like something out of a comic book…Justice League…Truth Squad. Today the Justice League won. Hurray!

Historians will use “troopergate” as a model of government gone wrong. It will be held as an example of a theocratic megalomaniac who illegally used government agencies to enforce her personal vendetta. AG Colberg or attorney Van Flein will file suit with the Alaska Supreme Court to thwart due process, reparation of injured individuals, the rights of Alaska state employees to know and operate under a system of transparency and honesty without fear of retribution, and the rights of all US citizens to understand how their prospective Vice President operates in her role as an executive of state.
Our Alaska State Supreme court, charged with protection of individual and citizen’s rights, must act without hesitation. Our Governor and Attorney General have allowed the welfare of our state to be co-opted by a political agency hell bent on advancing their own agenda, not the will of the people. Governor Palin alone is responsible for this travesty.
ok…i realize that I may have seriously overreacted here…..but the mere mention of exxon makes me ill…and I really do believe biden was “testing” her on her knowledge about energy and state affairs…and she came up short. for those of us in the lower ’48…exxon and the whole valdez catastrophe was an example of big oil vs. nature…and the supreme court ruling that sarah couldn’t come up with……FAVORED big oil business…and she couldn’t quite name it even though it had happened most recently! beth- so lesson to be learned here is…if your governor/elected representative happens to “luck” into national politics and there is a question of ethics/wrongdoing….it’s pretty much a FU (pardon my french) in terms of normal rules of law. better you than me here in colorado…where we seem to be getting bluer by the minute1 🙂

I will make it a priority to do plenty of campaigning for their opponents when they are up for re-election! And what in the hell is the deal with the neo-con lawyers representing them??????? I will say this…about mudflats and our wonderful alaskan friends here who rallied/protested/informed……you have provided us in the “swing” states (unlike yourselves who are as red as satan himself…sorry, couldn’t resist the analogy) with a lot of “food for thought” and real time info to fight the good fight with! and for that…you are pioneers in this information age! thank you, akm…and all alaskans…with the small voice in that “foreign land” up north!

At the rate of pissing off some of Alaskans, I must ask this question. Does your governor think Alaska is another country? I know she did this and that for the state, but I have never heard her say what she will do for America? How does she extend her tax cuts and breaks that she gave to you all to ” the lower 48?” In my book, I get pissed hearing her talk about Alaskans and how they work hard and how people are use to being productive up their. What a dumb bunny if she thinks that the rest of the country doesn’t work hard. It alienates her and her ticket from the rest of the country and no one has yet made that point. And another thing, unless the feds pay her to keep a watch on Russia from her living room. I wish she would shut the freak up and let that go. Foreign policy experience she does not have , meeting with Kissinger 1 time for an hour doesn’t mean he gave you a playbook.
My last thought, I’m a soccer and basketball mom but who the hell cares? When I’m on the field, we are talking about the game and cheering on our kids, not asking about tips for your 401K or yakking it up about the bailout. Get a grip and a life lady. shawn…I lived in alaska for 5 years….and yes, in some ways…unlike sarah tried to deny…living in alaska IS like living in another country. (she somehow tried to paint it tonight as “middle america” (whaaaaa?????))
I loved living in alaska and part of why I loved living in alaska….as I’m sure the alaskan friends here will testify to, is because it IS so different that the “lower ’48” ..because of the distance itself you are removed from much of what happens in the rest of the country. it was funny…when sarah tried to paint a picture of alaska NOT being a “foreign country” with katie couric in the interview….alaska IS, in many ways like a foreign country…but NOT!

Is it accurate for Colberg to refer to the state employees who have been subpoenaed as “his clients”? Is he the Attorney General of the State of Alaska, or the Attorney General of the Executive Branch of the State of Alaska?
I know that the AK Constitution prescribes Gubanatorial appointment for the AG (which makes me wonder why it is supposedly so highly regarded by state constitution buffs), but what does it say about his responsibilities and loyalties?
I assume he was sworn in. Does the oath obligate him to the State, the Constitution, or the Executive?
I know I can find this out by reading the bloody Constitution, but I’m lazy. Any Alaskans happen to know?

EVERYONE – including Palin – agreed to the Legislature’s investigation before August 29.
NOTHING should have changed that. NOTHING.
I was so pleased to see that the judge refused to halt the Legislature’s investigation. The people of all 50 states have a right to know if a VP candidate has abused her powers as an elected official, i.e. Governor. It is for that reason that I as a resident of ID stay abreast of this issue.
The AK people have a right to know if their workers rights have been violated by a public official. They also need to know why they would go to jail if they did not honor a subpoena, but others would not when they failed to appear. They also have the right to know why these people are not being held in contempt.
I am also wondering why the Bar Association of AK has not censored an attorney that recommened that his client break the law?
Many complaints have been filed against Talis Colberg with the Alaska Bar. Each and every one of them must be followed up by law. AKM
Just a final remark on the “debate” before I hit the sack. Sarah probably shined, in the eyes of the folks who wouldn’t have changed their minds no matter what.
But I thought Joe was fantastic. I expected him to be professional and on top of the material, but he was also thoroughly engaging. He was (politely) in control throughout. He didn’t patronize, he didn’t berate, but he also didn’t let Sarah get away with spouting BS.
I hadn’t seen that much of him live before. I was really impressed.
Well Mudpuppies I’m going to call it a night. I very much enjoyed sharing the VP debate with you. It certainly didn’t change my mind, vote wise. I came in knowing I was an Obama person, but I did get a better idea of who Biden is and what a great choice Obama made when he picked him for his VP. Those two can really make a difference in this world. I’m going to sleep now and dream of all the wonderful possibilities, peace in our life time, affordable health care for all, education that every child in America can afford, that insures them meaningful careers where they achieve prosperity that does not send our children’s children into slave labor if they can not pay their taxes and a warm safe place for each person to lay their head at the end of the day.
Is anyone keeping track of the costs that have been incurred by the State of Alaska since all this crap began?
a) the cost of investigating Palin in the first place (including the $10,000 pay-off to the guy hired to replace Monegan then dismissed for being a perv/bigot)
and
b) the cost of the legal wrangling since Aug 29th since she flip-flopped and decided not to cooperate
Alaskans should send her a bill.

Tax returns supposed to be released today! Hooray! that means that those delusional women (& men) out there who think “she’s just like me” will finally get a clue!
Uh, she’s really just like you but earns $200,000 more per year! Why she & her stupid husband need to sit around the table wondering how to put the kids through college (how about getting them through high school first? you’re batting 1000 with drop-outs right now!) when they’ve earned nearly $300,000 for years & years & years is beyond me — has she never heard of savings? In her debate she talked about the “greed” of people living beyond their means, how the predatory lenders that allow it are the cause of the financial problems, and then she & her hubby with their plane & big house & vacation property & everything else are wondering how to put kids through college on only $300,000 per year. Bring on the taxes!!!!!!!!!!!!!

suchanut – the taxpayers are not the AG’s clients; employees of the state are to the extent that their work is part of their job description. Someone could make the argument that what they’ve done is beyond their official duties, but as long as those employees act within the confines of their official duties, the AG provides the legal representation. As for the petition, it will probably be handled in the same way that other political documents are handled… with great distain and inaction.

I, too, thought it odd that Palin did not jump all over the constant references to Exxon, especially as Biden continually made mention of the $4 billion tax break McCain wants to give that company. Strange how Palin spoke against the court ruling which allowed Exxon to not pay the full amount in damages for the oil spill, but then remains silent about giving them a massive tax break (more than enough to offset any amount they’d have to pay in Valdez damages). Guess it’s just not politically expedient to say/do the right thing, eh, Sarah?

When corruption is halted by judges who see the light in Alaska, perhaps the whole USA will know the truth about a corrupt governor who has double talked her way to US everyday since being named a VP nominee for John McCain.
