Obama Campaign Files Suit Over Voter Suppression

Disturbing allegations of new “caging” techniques being implemented by the Republican party have surfaced in Michigan. The Republican Party Chairman in Macomb County, Michigan, (a swing county in a swing state) is planning to use a list of foreclosed homes as a resource to block voters in the upcoming election. Lose you home, lose your vote. And, yes, most of the foreclosed homes in Michigan affect African-American families. The use of these lists is an attempt to challenge that these voters are “true residents” of the state, a requirement to vote.

While this type of Republican tactic is far from surprising, what is surprising is that the Obama campaign is filing suit. They will seek an injunction to prevent the GOP from engaging in this type of voter suppression. Here’s the statement. The Obama campaign:

…seeks declaratory and injunctive relief to challenge the “lose your home, lose your vote” vote-suppression program adopted by the Macomb County Republican Party, in concert with the Michigan Republican Party and the Republican National Committee, as well as unnamed Defendants who will implement the scheme at polling places in Macomb County and throughout the state. This “lose your home, lose your vote” program is part of a broader scheme – misnamed an “election integrity” program – to harass voters and suppress the vote throughout the State of Michigan in the upcoming election on November 4.

Despite the fact that thousands of Michigan voters’ homes have been foreclosed, many residents are still living in them, but will nonetheless be disenfranchised, if the Republican party has its way. The good news here is that the Obama campaign is being proactive. Democrats (and the country) are still suffering from the fallout of the elections of 2000 and 2004. They’ve been burned once…twice… and are positively bristling with a “never again” attitude that will serve them well.

Seeing Obama taking a strong stand on these policies which he refers to as a “national and systematic program” is a good thing. They are taking it seriously. As much as we don’t want to imagine the scenario, Obama needs to be ready to legally challenge the vote in November if the signs of vote tampering/voter fraud rear their ugly heads. They can’t ‘blink’. (I humbly apologize for the use of that analogy)

Many of the same suspect voting machines that were in play in the last two elections still exist. There has been no significant vote reform and there’s nothing we can do about that at this point. What we can do is be the eyes and ears at the polling places.

The election watchdog group Black Box Voting, has sent out the following request. If you are not familiar with this group, you should be. The website is extensive, and there’s also a great documentary Hacking Democracy (available on Netflix) which tells the story of this organization and the amazing woman who started it all. This is possibly the single most important issue facing our country, because without preserving the integrity of the vote, we have nothing.

They also have a downloadable Tool Kit for the upcoming election on the website.

So do what you can. If you’re a blogger, post this. If you’re a tech, read below and get a job. Engaged citizen? Go to the website to learn more. Download a tool kit. Be prepared and know what to look for at your polling place.

It happens everywhere. In 2004 there were districts in Alaska that reported a voter turnout of more than 200%. I like to think we’re politically engaged, but not to the point that every registered voter makes it to the polls twice. These issues have still not been resolved. And who is heading up the division of Elections for the upcoming vote in 2008? Sarah Palin’s Lieutenant Governor Sean Parnell.

This post will no doubt produce howls of objection for the vendors that read it. Black Box Voting is encouraging all individuals with a technical background to search and apply for temporary tech ELECTION SUPPORT jobs for the November 2008 election.

Hiring is underway for temporary technicians to help with voting machines this fall. Vendor dependence is undermining the structure of US elections, as described here in the new report by VotersUnite.org:

HOW TO FIND TEMPORARY ELECTION TECH POSITIONS:

In a presidential election year, voting machine vendors will hire and train thousands of technicians staffed around the country. For example, anywhere that Election Systems & Software has a machine, they are under contract to provide an on-site support tech. Hart Intercivic, Premier (Diebold), and Sequoia also use Election Day support technicians.

Temporary election tech support jobs have been spotted on hotjobs.com, rollouts.com, and local tech temp firms like (in 2006) DecisionOne. The tech services firm may be a subcontractor for the big four voting machine companies. Sometimes you’ll find the positions advertised by your local county.

Sites like Rollouts.com have you register in their E-tech database. They search for techs based on skill set and area. There isn’t much in the way of a skill set needed for the election projects.

QUIETLY APPLY FOR THE JOBS

Anyone with tech skills interested in safeguarding the November election is encouraged to register at technical recruiting sites and apply for any election-related projects.

CONSIDER ASKING FOR TIME OFF ON YOUR FULL TIME JOB TO DO THIS. This November, there may be no better way to watch the behind-the-scenes process than to be a stagehand, so to speak.

It is not the vendor, and not the government, that has the right to elections information, it is the PUBLIC. Citizens have inalienable rights to sovereignty over the government they created and pay for. These rights cannot be honored without mechanisms to see all information related to elections, and ultimately, to have control processes that honor citizen sovereignty.

That said, it ain’t gonna happen this November. Therefore it is entirely appropriate, patriotic, and important, for citizens to apply for temporary positions as voting machine technicians to provide inside public oversight for the process.

There will be nondisclosure agreements, which are not appropriate at all for public elections, but it’s a reality now that vendors are trespassing on citizen right to know. There may be issues that arise which the public clearly has a right to know. When that happens, a decision must be made.

YOU WON’T BE THE FIRST

We have already been in communications with other patriotic volunteers who have successfully obtained these positions in the past, and are doing this for November.

THERE ARE ALWAYS WAYS TO DEAL WITH IMPORTANT ISSUES IF THEY ENDANGER THE PUBLIC GOOD. You, the People, are needed on the inside of the elections industry this November.

I know that for a fact that some of those going through disclosure might still be living in their home. This is what disturbs me the most about this tactic. There could be some real shouting matches at the polls in Nov. if these lists are used in this way. Bottom line, they’ll probably have to walk away from voting.

@ Bec – Quite right. Once foreclosure is filed, the full process can take months to years. Meanwhile, people often continue to live in the home. Also, FDIC has stopped IndyMac from proceeding with foreclosures for the time being. Also, filing for BK can halt the process in its tracks. Once the process is complete, the (former) homeowner may still be in home, renting it from the bank or new owner.

It’s just one more sleazy attack on the right to vote. And a particularly heinous one that really kicks people when they down and out.

Buddha bless y’all for getting the word out. I live in the next county up from Palm Beach–yeah, that Palm Beach.

We (Martin, unfortunately a very RED county) were the only county in FL that did not have major problems. Why? Because we used the old fashioned voting machines. But of COURSE, we had to switch to electronic machines for 2004. With no paper trail. Now, we have optical scans which do validate the ballot in front of the voter, tell you if you undervoted, etc. It’s not perfect, but better than last election.

If I wasn’t a complete Luddite, I’d take a couple of weeks vaca and do it. Unfortunately, I need IT when the plug comes out of the wall.

BREAKING NEWS: Fellow Mudflatters, here’s something else to ponder. It appears the Bob Barr lawsuit in Texas (pending in the Texas Supreme Court) is real. This story moved from the Dallas Morning News’ Trail Blazer Blog to the “Top Stories” in Local News category.

According to this article, Barr claims in his lawsuit that the Repubs and the Dems “missed a state deadline to certify the names of their presidential and vice presidential candidates for the Texas ballot.”

The article says that “[T]he (Texas) Supreme Court has refused to dismiss the case outright and has asked all parties to file their response to the lawsuit by Monday.”

So hold on to your hats. This is getting interesting, folks!

It is probably a pretty good guess that none of those homeowners facing foreclosure will be voting for Mc Cain.
The repubs are becoming increasingly scared about this election and will resort to anything to win.
It would not surprise me if they pulled palin out of the vp pick and installed someone else. She just looks more bewildered and weary by the day.
If that happens it will be a result of the efforts by people like you who have opened a forum for people to learn and to speak.

It would definitely be OK for Obama as McCain is counting on the 34 electoral votes. I think Texas has been red since the mid ’70s (as long as I have lived here; sad indeed). However, I don’t know what Texas’ write in laws are.

If the Texas Supreme Court throws both parties off of the ballot and write ins are allowed, can’t you just see the mess at the polls? Well, actually, things would still be a mess if write ins aren’t allowed. Part of me hopes Barr wins his challenge and the other part hopes he doesn’t due the assured ensuing chaos. (sigh)

Voter suppression is just one of the many tactics they are now using to try and steal the election, I’ve known they were doing this for some time (I’ve even written two posts on it) I heard yesterday that the Obama campaign was going to sue over it, the sad part is, federal court systems can sometimes take months or even years to make a decision on these things, and we only have weeks, the suit will help to stall their efforts, but it wont stop them unless the courts act quickly, and they are still harassing voters and calling them to give them polling places changes that never happened, and telling thousands of voters they will be arrested at the polling places if they try to vote while they have unpaid parking tickets, owe back child support, are on probation or, in at least one area, if you don’t speak English.

Myself I am going to hang around my local polling site and watch for challengers, if I spot any I plan to challenge their ass right out of there, and I’m getting several of my friends to do the same in their districts, including some who are pretty intimidating themselves, like a rather large police officer and several members of area biker groups that are already active doing rides for charities and for donations for political activities (like getting those commercials on the air about aerial hunting).

Living in Arizona for the last 28 years, I have seen John McCain change over the last few years. I think he is in the first stages of senility. I don’t think he is healthy and I’m sure that the grueling campaigning has taken its toll.

He has always had a temper. As a matter of fact it was something he was kind of proud of and bragged about from time to time. He really was something of a maverick at one time, but he’s sold he soul now. There is no turning back. He is at the mercy of those talking heads in his campaign and he’s too far gone to change now, even if he knew how to. I really don’t think he is in control of his life at this point.

I feel sorry for the man. He is a shell of what he once was and absolutely in no condition to be our president.

Make no mistake, folks – and today’s voting news is a reminder – we are in a great fight for the future nature of our country. I am currently reading Truth and Duty by Mary Mapes – where Mary and Dan Rather were destroyed by the far right bloggers in an orchestrated attack. She was the reporter who exposed Abu Ghraib and was targeted by the right – when she broke the story about Bush’s National Guard service, she was discredited and lost her job. The neo con bloggers had their day in that fight and the outcome was a disgrace. After that debacle at CBS, the press was completely bullied and abandoned it’s role in safeguarding our country by exposing corruption and asking the important questions. It is now the left blogging community that have taken up the gauntlet and are now asking those questions, uniting the liberal community, and pushing for the truth to be revealed and spread. We are really indebted to Muckraker and the other bloggers. These forums are not only an outlet for our frustration but more importantly, they stand up to those in power. Muckraker is an excellent investigative journalist, and I hereby create the Mary Mapes award (insert magic wand sound) and present it to her with gratitude and respect!!

AlwaysAmazed1 (12:42:32) I was an election judge & Dem precinct committeeperson in Texas until 1995. If things are the same (and they hadn’t changed it in 20 years then, but heck they could’ve ya know?) to write in you just write in… there should be a place on your ballot… back in the voting card day, you just wrote it in the top portion of the ballot. Poll workers had to look at every ballot before they split them in half to make sure there wasn’t a write in. Now with electronic voting… dunno how you guys are doing it… we’re using scantron type ballots so we mark the block and/or write in and the scanner scans… upshot… you should be able to write in without even asking how, but you can always ask the precinct committee person or election judge. And Yes it would be a HUGE mess and one that would be rife with corruption.

Cartoon Pig Dog: contact your local branch of the Dem Party and sign on for a Poll Watcher position and watch the watchers. That was my plan … BUT I saw today in my local paper that the county judge for elections is hiring temporary machine workers!!! Yaaayyy!!!

There is a very simple way for the Democrats to stop the Republicans from vote caging and stealing another election. They should be encouraging all Democrats to vote Absentee. That will solve the problem with the people who are losing their homes. It will also solve the problems of people who have a hard time getting to the precinct to vote.

Oregon has been voting by mail for years and has had no problems. Just think, you can vote from the privacy of your own home, no waiting in lines, and no one challenging your vote.

Besides, think of how much havoc it would cause if all Democrats voted absentee. The news organizations would not be able to call any race because it takes a lot longer to count absentee ballots.

I’d just like to point out that the majority of Americans will not see a problem with purging foreclosed addresses, because they don’t understand that people can and do live in their foreclosed homes for months/years (varies according to state) after the foreclosure. I suppose we’re also going to run into the problem of “people who don’t pay their bills shouldn’t be able to vote” as well.

I swear. I spend most of my life these days feeling like I fell down a rabbit hole.

However, I don’t think it’s too much worse than the states that have instituted the requirement to show a government-issued ID in order to vote – how many people has that move disenfranchised?

Thanks for the thumbs up and for including the link. I was actually a history major way back when, then did grad work in Middle East studies and modernization theory. I read a lot and have the ability to synthesize information, thus connecting the dots. I tend to think that’s an innate female capability. Men can develop it, but I’m not sure it comes as naturally to them.

Anyway, a friend sent me a video clip of a relationships counselor who has a marvelously comedic way of describing men’s and women’s brains. Says men’s brains are composed of a variety of boxes, none of them touching. Women’s are more like the Internet — a tangle of wires. Same thing as the Mars and Venus thing, but hilarious.

I wonder if that’s relevant to the way women seem to be quicker at seeing through SWWNBN’s facade than men, especially when she also has eye candy going for her….

His military record is NOT stellar. Yes, he spent time in captivity. Yes, he gave information to the Vietnamese in violtion of the US POW Code of Conduct. Yes, his shipmates called him a liar and a bully.

Last week in SE MN we got a McCain mailer with an application for an ‘absentee ballot.’ Addressed to my husband, not me. We are both registered but I have voted more frequently, in the primaries, etc. and do not usually vote Republican unless it is a good candidate. In MN you just register to vote, not by party.

Took it in to the DFL office here, because why would McCain’s folks send us a voter reg? Turns out that it’s a caging tactic. You send it back and it can conveniently get ‘lost’ in the mail if it isn’t entered into the system in 3 days. Then you go to vote and they tell you since you already sent in an AB, you already voted and you can’t, even though you didn’t.

And this is in MN! I used to live in GA, and I can just imagine what it’s like there these days in terms of voting.

I’m not really trusting AB forms these days. In Oregon, yes, but there’s not as much precedent for it here, so, I will physically cast my vote this year.

If you get any strange mailers, question them, take them to your local precinct office. It’s funny business time.

We don’t use voting machines (Vermont) but readers. But I have volunteered to work at the polls (this is a paid job) and that’s also a way to keep watch on what’s going on. The parties also have poll watchers and could use volunteers.

Here in Wisconsin, our Attorney General, JB Van Hollen, has filed a suit against the Election Board to force them to match the voter registration files against DOT files. Not just the new registrants, which we have been doing, but ALL voters. If the files do not match, he wants the name stricken from the voter file.

So you show up at the polling station, and they don’t have your name on file like they have for the past 20 years. You get a provisional ballot and your vote does not count until you bring in the supporting documentation that proves your residency. Even if the clerk knows your parents, and babysat your kids.

Unfortunately, our DOT will not use hyphens in people’s last names – if you have a hyphenated name, they run it all together (Maryann Smith-Brown would be Maryann Smithbrown). Mismatch – name stricken.

If your name is Maryann, and you go by Mary, your DOT file would say Maryann, but your voting file might say Mary. Mismatch – name stricken.

Say your name is Maryann La Follette, the DOT enters it as Lafollette. Your voter file says Maryann La Follette. Mismatch – name stricken

If your name is Maryann and someone on either file typed it Maryanne… Mismatch – name stricken. Think of all the different spellings of names these days – I can never guess how names are spelled anymore – I always have to ask. How easy would it be for a typo to occur?

And then there is the foreclosure problem here as well… I’m sure many of these voters will have issues with their files matching. This isn’t just about names, but about addresses as well. So you moved 2 months ago

Don’t think this will be much of a problem? 4 out of the 6 members of the Election Board (all retired judges who probably have voted every time since they’ve been 18) had mismatches. They estimate that this will be a problem for 20% of the voters. We are a heavy turn out state – almost 73% or 3,000,000 voters in 2004. I think it will be even more impressive this year. Okay, simple math here, 3,000,000 x .20 = 600,000 voters that will have to fill out provisional ballots. Think that might sway the numbers at the end of the night in a swing state?

This suit was brought on September 11, 2008, leaving the local city and town clerks with less than 2 months to manage this monumental task – time when they need to be processing absentee ballots, registering voters, and training poll volunteers, along with their everyday duties. This is so obviously a partisan ploy!

I don’t think I’ll have a problem, but they probably won’t have anyone checking this stuff in my 95% white little burg. They’ll be set up in Milwaukee and Madison where there is a much larger student and ethnic population. Think about how long it will take to vote if they have to be cross checking 2 databases (goodness knows they won’t have time to do it before the election – there are less than 7 weeks!), then providing provisional ballots to all the mismatched voters. Who can’t afford to stand in line for several hours to vote? Yup, those of us with job(s) where we have to punch in on time. Also the ones more likely to vote for Obama.

We have a lot of people up in arms to prevent this suit from taking effect. Hopefully, the short time frame alone will prevent it from succeeding.

I beleive an absentee ballot is in order if you live in place other than what is registered. In the state of Arizona we can vote an early ballot, however there is a cut off date and you have to notify your election board to request an early ballot. If you go to the Obama website you can click on a link to direct you what may apply in your state. Today I received our requests for eary ballots.
They are ecouraging everyone to vote an early ballot especially in areas where they expect devious tactics to thwart your vote could occur.

The campaign had to issue what was in effect a translation!

I’m not positive, but fighter pilots are trained to try to evade missiles. After the SAM locked onto him, he decided to go ahead and try to finish his bombing run. The SAM got his plane, but he ejected and landed in the lake.

There’s another incident that occurred a month earlier while he was stationed on the Forrestal. Details aren’t clear, but over 100 sailors died when somehow a missile mounted on a plane exploded. McCain was in a plane ahead of the one carrying that missile. He transfered to another ship, the Oriskany, before the investigation was very far along. I’ve heard it was the next day. Some of the stories are pretty nasty, and the official record doesn’t make mention of any of those charges. All that happened about a month before he was shot down.

I can say that the Navy’s official explanation doesn’t always square with the facts, any more than the Army’s did regarding Pat Tillman’s death. If you recall the indicent in 1989 aboard the USS Iowa when the gun turret exploded, the initial explanation was that it was caused by a young gay sailor committing suicide. My ex was part of the investigation. They were looking into the bags of propellant, since they were of WWII vintage. He said at the time that they had to be extremely careful as they pulled the bags out of the bunkers to test them due to high levels of ether, a decay product of the propellant. Ether is the stuff they use in quick start sprays for engines because it’s extremely volatile. Eventually, the Navy had to change its story, and I don’t remember what they finally settled on, but you can draw your own conclusions.

I posted this in an earlier thread, but want to do so again. Some residents of NJ have been told they are not registered to vote because the name on their DMV record does match the name on their voter registration record.

Fortunately, the governing officials in the counties where this has happened have been forthright in saying that DMV name does NOT have to match voter registration name.

But, folks, we are headed toward being a “papers please” nation, i.e., REAL ID (even though many states have rejected it); you can’t fly without ID. I am praying that PRESIDENT OBAMA will turn this around.

@AZtopcat I used to live in Calif., and our polling place was often changed. This was because they used garages of homes, school auditoriums, and sometimes recreation rooms of independent living places (euphamism for old folks’ home). The poll people had to depend on such places allowing them to use the space, so it often changed from one person’s garage to another’s. Also, as our neighborhood grew, the need for polling places increased, and new sites were added. I suspect that in AZ it is similar; practicalities are causing the changes, not anything sinister. : )

I’ve been lurking from Sarah day 1, but I’ve felt I didn’t have much to add, but….

I’m Australian, and I’ve always been amazed that the US allows state governments to conduct the federal election.

In Australia we have an Electoral Commission (www.aec.gov.au) that is part of the public service, is utterly non-partisan, and is responsible for both the setting of electoral district boundaries and the conduct of elections (which is uniform nationwide, and paper-based to allow complete scrutiny).

Perhaps a Democrat administration might be persuaded to establish a similar independent body in the US – I can’t see any downside. Would there be a problem removing the responsibility for conducting elections from the individual states – some legal impediment?

I worked in Ohio during the last presidential election.
I then returned following the election for a recount (not official, someone though I was helping went to every site and obtained info)

I just happened to come alone a rally in Columbus on voting rights, where Jessie Jackson was there.
I listened as people got up and told their stories. horrible stories of how they were denied the right to vote. Some had received letters on letterhead that seemed offical…that stated due to high voter turn out Rep would vote on one day and Dem on another day (guess which one was right), how people would go in to vote and be told they were at the wrong place – not being told they were only at the wrong TABLE, tickets were issued for parking while voting (guess where….hint not the suburbs), etc etc

Later Rep Conyers from Mi wrote a report on it…I think it is still available on net

I came back and wrote letter to the editor of my paper.

As an American, no matter what party Rep, Dem, Green, etc, I was appalled that anyone would be denied the right to vote! Our vote is one of our most precious, cherished rights…hey it is what started the whole revolution…taxation without representation….

I am scared with this election…Winning is more important than Country

by the way the head of the board of elections in the last pres election was also the head of Bush’s campaign in that State…sound like Florida???

Re: Absentee applications – my best friend in VA received one from the McCain campaign. He has been a registered Dem for 20 years, hasn’t moved in 10 and did not request an AB.

Re: Texas – After the St. Paul convention I read about the Barr challenge. Because the conventions were so late this year, both missed the filing deadline in Texas. I think it was around 20 August. The article I read said it w as just a technicality and all would be OK. Now I wonder….

I read at BBV.org the other day to find out if you can hand deliver your Absentee into your voting precinct. They said the best choice is vote at the poll, if all they have is electronic, ask for a paper ballot. They suggested also to hand carry your absentee ballot in to your local precinct.
So the US Postal Service is not safe now?
